29 CFR  1910.29(b)(13)(i): 1910.29(b)(13)(i): The guardrail system opening used around holes that serve as points of access (such as ladderways),  did not have a self-closing gate that slides or swings away from the hole, and was equipped with a top rail and midrail or equivalent intermediate member that met the requirements in paragraph (b) of this section:   At the jobsite located at 337 County Road 6, Tribune, Kansas, employees engaged in grain handling activities, were exposed to fall hazards of approximately 24 feet from the working platform to the concrete below in that the access ladder above the boot pit opening was not equipped with a  self-closing gate.

29 CFR  1910.29(b)(13)(ii) The employer did not ensure that each opening was offset to prevent an employee from walking or falling into the hole:   At the jobsite located at 337 County Road 6, Tribune, Kansas, employees engaged in grain handling activities, were exposed to fall hazards of approximately 24 feet from the working platform to the concrete below in that the employer did not ensure that the cover for the booth pit was secured to prevent an employee from walking or falling into the hole.
