29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s)  On or about July 5, 2021, and at times prior thereto, the employer had not performed inspections of the jobsite to ensure the safety of workers performing tasks at elevated heights, exposing workers to the hazard of falling approximately 22-feet to the ground below.

29 CFR  1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On or about July 5, 2021, and at times prior thereto, a worker was hanging plastic sheeting on an unprotected 3rd story balcony without the use of fall protection, exposing the worker to the hazard of falling approximately 22 feet to the ground below.

29 CFR  1926.503(a)(2)(iii): The employer did not assure that each employee has been trained, as necessary, by a competent person in the use and operation of guardrail systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used.   On or about July 5, 2021, and at times prior thereto, workers were required to perform various work tasks on unprotected balconies without receiving training on the use of fall protection, exposing the workers to the hazard of falling from elevated heights up to approximately 22 feet.
