OSH Act of 1971 Section 5(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about June 30, 2021, and at times prior to, the Gehl Rs8 42 rough terrain forklift was operated without the use of the provided seat-belt and on uneven surfaces exposing employees to struck-by hazards. Feasible abatement includes, but is not limited to, ensuring compliance with ANSI/ITSDF B56.6-2011 Safety Standards for Rough Terrain Forklift Trucks sections 5.3.2, 5.17, 6.2.1 and 6.3.12 which includes but is not limited to enforcing the use of the seatbelt at all times while operating the lift, providing training to all operators, and ensuring the terrain conditions are accounted for during operations.
