29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  (a)  Awning 14 Street Side - On or about July 13, 2021, a carpenter was exposed to flying particles while operating portable hand tools such as, but not limited to, a Milwaukee screw drill and a black Sawzall without eye protection.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

29 CFR  1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  (a)  Awning 14th Street Side -  On or about July 13, 2021, employees performing roof repair,  painting, cleaning and small repair work activities were exposed to an approximately 11 foot fall hazard onto the concrete surface below, while  standing on, and at the edge, of the awning without using fall protection.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   (a) Awning 14 Street Side -  On or about July 13, 2021, workers used a ladder that was approximately 18 inches above the upper landing to access their work area and were exposed to an approximately 11 foot fall hazard onto the concrete and metal fence below.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

29 CFR  1926.95(d)(6): The employer required employees to provide or pay for his or her own PPE that was not excepted by paragraphs (d)(2) through (d)(5) of this section:  (a) Awning 14 Street Side - On or about July 13, 2021, a carpenter used a Milwaukee screw drill and a black Sawzall to cut the wood used to repair the Awning roof, and the employee was required to buy his own safety glasses and hardhat.
