OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards from falling or collapsing wood trusses.  Tom Berceau Construction, LLC at the worksite of Olde River Condo #6 3100 Riverside Dr Allouez, Wisconsin:  On July 13, 2021, employees installing truss spacers and nailing bottom chords to wall top plates were exposed to struck-by hazards when walking on and between trusses that had not been braced to resist out-of-plane buckling, leaning, and/or collapse due to the lack of top chord, web member, and bottom chord bracing.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  On July 13, 2021 at the worksite of Olde River Condo #6 3100 Riverside Dr Allouez, Wisconsin, three employees were exposed to fall hazards of ten feet without being protected by a conventional form of fall protection.   The employees were walking on wall top plates and/or bottom chords ten feet above surface level while installing trusses.

29 CFR  1926.503(b)(1): The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.
