OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to a struck-by hazard:    (a) On or about April 10, 2021 at the jobsite, employees performing tree care operations were exposed to a tree collapse hazard from overhead falling branches and a heavily decayed tree.

29 CFR 1904.39(a)(1): Within eight (8) hours after the death of any employee as a result of a work-related incident, the employer did not report the fatality to the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor.  (a) On or about April 10, 2021, an employee was performing tree care operations and died from falling to the ground below. The employer did not report the work-related fatality of an employee to OSHA within eight (8) hours.
