29 CFR  1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s):   a. 105 Hillside Ave., Metuchen, NJ - Roof   The employer did not provide effective training to employees in the recognition of unsafe conditions and method to avoid such hazards.  Employees engaged in residential roofing activities were exposed to hazards that included, but were not limited to, fall hazards from the roof while working and not utilizing fall protection, struck by hazards by debris and/or materials falling from the roof, and the use of ladders that were damaged and not taken out of service.   Violation occurred on or about July 21, 2021

Employees engaged in the clean-up of residential roofing materials, working directly below employees disposing of roofing materials from the roof, were not protected by use of hardhats. Employees engaged in the removal of roofing materials, from a third story, high pitch roof, were not protected from falls by use of personal fall arrest system or safety net system. 29 CFR  1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:   a.  105 Hillside Ave., Metuchen, NJ - Roof access  The employer did not ensure that portable ladders with structural defects were removed from service.   Employees engaged in residential roofing activities used a Werner Aluminum extension ladder with defects that included, but were not limited to bent rungs, missing rungs, and missing feet at the base, that was not taken out of served or marked "Do Not Use".     Violation observed on or about July 21, 2021
