29 CFR 1926.502(d)(21): Personal fall arrest systems were not inspected prior to each use for wear, damage, and other deterioration, and/or defective components were not removed from service: East Hillside Exterior Casino: On or before July 22, 2021, The employer did not ensure the defective, deteriorated fall protection harness was removed from service. The D-ring Holding buckle was missing on the harness which caused the D-ring the inability to say in place at center of the wearer's back. Employees were exposed to 25 foot fall hazard(s).

Casino Exterior East Hillside: On or before July 22, 2021 the employer did not ensure a written fall protection training certification record was prepared which included the identities of employees trained, dates of training, and the signature of the trainer or employer. This condition exposed the employees to a 25 foot fall. Employee(s) were exposed to fall hazard(s).

29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill: Casino Exterior East Hillside: On or before July 22, 2021 the employer did not ensure employees were protected from injury, in that employee(s) were using a boom lift to access their work area to remove angle iron and clean the sign and were tied off to the boom lift basket wearing a fall protection harness and lanyard. The employee had worn the fall protection harness improperly. The D-ring was located at the employees back waistline. The chest-strap was too low and the leg straps were loose. This condition exposed the employees to a fall of approximately 25 feet.
