OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from incoming vehicular traffic while picking up vegetation debris: On or about July 29, 2021, at 689 Nettles Boulevard, Jensen Beach, Florida, employees were exposed to struck-by hazards from incoming vehicular traffic while picking up palm tree leaves on an active roadway without the use of a traffic control plan.

29 CFR 1910.30(a)(1): The employer did not provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart before any employee is exposed to a fall hazard. And/or the employer did not ensure employees are trained in the requirements of this paragraph on or before July 29, 2021: On or about July 29, 2021, at 689 Nettles Boulevard, Jensen Beach, Florida, employees lacking fall protection training about the use of fall personal protective equipment (PPE) were exposed to approximately 25-foot fall hazards while performing palm cutting tree services.
