29 CFR 1926.651(j)(2):  Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  MICHAEL T.'S PLUMBING & HEATING, INC. at 9140 Huron Street, Thornton, CO 80260:  On July 30, 2021 the creating and exposing employer did not ensure excavated materials were at least 2 feet from the edge, in that a spoils pile situated on the east side of the excavation was approximately 6 inches from the edge of the excavation. Subcontractors and employees were required to work in the excavation measuring approximately 9 feet deep in the area beneath the spoils pile. This condition exposed the subcontractors(s) and employee(s) to struck-by hazards.
