29 CFR 1926.20(b)(1):The employer did not initiate and maintain accident prevention programs as necessary to comply with this part: a) Jose Cepede located at 971 Landings Loop, Westerville, OH 43082: On and preceding August 4, 2021, the employer did not initiate and maintain accident prevention programs to ensure employees were protected from hazards of the job. Accident prevention programs were not in place to ensure a crew performing a re-roof on a multi-story residential home utilized ladders properly and wore proper personal protective equipment (PPE) including fall protection which exposed the crew to struck by and fall hazards up to 25 feet.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: a) Jose Cepede located at 971 Landings Loop, Westerville, OH 43082: On and preceding August 4, 2021, the employer did not ensure that employees working as a part of a roofing crew performing duties which exposed them to falling objects were provided with and utilized head protection. Roofers working on different levels and cleaning up on ground level beneath falling materials were not utilizing head protection which exposed them to struck-by hazards to the head.

Roofers were removing shingles and other materials on a roof that varied from 10-25 feet. The employees were not utilizing proper fall protection which exposed them to falls up to 25 feet.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) Jose Cepede located at 971 Landings Loop, Westerville, OH 43082: On and preceding August 4, 2021, the employer did not ensure that the extension ladders used to access the roof extended at least 3 feet beyond the upper landing. Employees were utilizing an extension ladder to access the lower roof with the side rails extending 10 inches beyond the upper landing without the ladder secured. The following condition exposed employees to falls up to 12 feet.
