29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface were not used: a) North side of lot 4 & 5: On August 3, 2021; an employee climbed onto a permanent railing and then climbed up to the top, working level of a scaffold. The top of the balcony railing was 23 feet high, while the top, working level of the scaffold was over 25 feet high. Note) Certification and documentation of corrective action are required for this item.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection: a) East side of Lot 4 & 5: On August 3, 2021 and at times prior thereto; employees performed soffit and fascia work from a scaffold system without fall protection. Guardrails or other means of personal fall protection were not used, exposing the employees to falls ranging from 13 feet to over 25 feet to the ground below. b) North side of Lot 4 & 5: On August 3, 2021 and at times prior thereto; an employee performed soffit and fascia work from a scaffold plank located between the railings of two balconies without fall protection. Guardrails or other means of personal fall protection were not used, exposing the employee to a 13.5 foot fall to the ground below. Note) Certification and documentation of corrective actions are required for these items.

29 CFR 1926.454(a): The employer did not have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards: a) On August 3, 2021 and at times prior thereto; employees performed soffit and fascia activities from multiple scaffold systems without guardrails or other means of fall protection. The scaffolds varied in height from 13 feet to over 25 feet high. The employees did not have the knowledge to recognize the hazards or to take the actions needed to minimize these hazards.
