29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  (a) Wesley Enhanced Living Pennypack Park located at 8401 Roosevelt Blvd. Philadelphia, PA: On or about August 18, 2021, the employer did not provide a medical evaluation to determine each employee's ability to use a respirator before requiring the use. The employer required employees to wear N95 filtering facepiece respirators such as but not limited to Makrite SEKURA (TC-84A-7638) and 3M 1860 (38-9019-1493-7) while providing care to suspected and confirmed positive COVID-19 residents.

29 CFR 1910.134(f)(2): Employees using tight-fitting facepiece respirators were not fit tested prior to initial use of the respirator, and whenever a different respirator facepiece (size, style, model or make) was used:  Wesley Enhanced Living Pennypack Park located at 8401 Roosevelt Blvd. Philadelphia, PA:   (a) On or about October 14, 2021 and thereafter, employees required to wear filtering facepiece respirators were not fit tested prior to required use. The employer required employees to wear N95 filtering facepiece respirators such as but not limited to Makrite SEKURA (TC-84A-7638), and 3M 1860 (38-9019-1493-7) respirators to protect against the SARS-CoV-2 virus while providing care to suspected and confirmed positive COVID-19 residents.  (b) On or about August 18, 2021, the employer did not ensure that employees required to use respirators were fit tested with the same make, model, and size whenever new respirator was used at the site. The employer required employees to wear N95 filtering facepiece respirators such as but not limited to Makrite SEKURA (TC-84A-7638), and 3M 1860 (38-9019-1493-7) respirators to protect against the SARS-CoV-2 virus while providing care to suspected and confirmed positive COVID-19 residents.

29 CFR 1910.134(e)(5)(i): The following information must be provided to the PLHCP before the PLHCP makes a recommendation concerning an employee's ability to use a respirator:  (a) Wesley Enhanced Living Pennypack Park located at 8401 Roosevelt Blvd. Philadelphia, PA: On or about August 18, 2021 the employer did not provide supplemental information such as, but not limited to, expected physical work effort, duration and frequency of respirator use, a copy of the written respiratory protection program and the 1910.134 respiratory protection standard, to the PLHCP who was making recommendations concerning employees ability to use a respirator.

29 CFR 1910.134(m)(2)(i): The employer did not establish a record of the qualitative and quantitative fit tests administered to an employee which included the information required by 29 CFR 1910.134(m)(2)(i)(A) through (m)(2)(i)(E):  (a) Wesley Enhanced Living Pennypack Park located at 8401 Roosevelt Blvd. Philadelphia, PA: The employer did not ensure that fit test records included all of the required information such as but not limited to the type of the fit test performed, the date of the fit test and the pass/fail results. The employees were required to wear N95 filtering facepiece respirators such as but not limited to Makrite SEKURA (TC-84A-7638) and 3M 1860 (38-9019-1493-7) while providing care to suspected and confirmed positive COVID-19 residents.  Condition noted on or about August 18, 2021.
