29 CFR  1910.1200(e)(1):  The standard is applicable to construction employment as referenced by 1926.59   The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    The employer is failing to protect employees from hazardous chemicals by not having a written communication program -   This was most recently documented on or about August 18th, 2021 at 177th and 370 highway in Omaha, Nebraska. The employer has failed to protect their employees from health hazards by not developing a written comprehensive hazard communication program.  Hazardous chemicals used at the jobsite included solvent cement for PVC plastic pipes.  Employer did not have a written or verbal program to inform employees about the the health hazards associated with the solvent cement.

The employer is failing to protect employees from hazardous chemicals by not maintaining the required safety data sheets for the hazardous chemical that was being used in the workplace. -   This was most recently documented on or about August 18th, 2021 at 177th and 370 highway in Omaha, Nebraska.  Hazardous chemicals used at the jobsite included solvent cement for PVC plastic pipes. The hazard identified can cause  eye, skin, and respiratory tract irritation.

The employer is failing to protect employees from fall hazards. This was most recently documented on or about August 18th, 2021 at 177th and highway 370 Omaha, Nebraska.  An employee was observed working inside of trench that was approximately 48 inches wide and 6 feet deep.  The employee was boring in 5 inch and 2 inch PVC conduit.  Various hand tools were located approximately 1foot from the edge of the trench - Furthermore, there was also an auger bit located 20 inches from the edge of the trench.
