Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system.  The employer is failing to protect employees from fall hazards while performing residential framing activities. This was most recently observed at 7610 Kilpatrick Parkway, Bennington NE 68007, on August 8th, 2021, where the employer has employees working directly adjacent to an unprotected edge of a residential structure.

29 CFR  1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access.  The employer is failing to protect employees from fall hazards while performing residential framing activities. This was most recently observed at 7610 Kilpatrick Parkway, Bennington NE 68007, on August 8th, 2021, where the employer has employees accessing and egressing the overhead beams of a residential structure using an A-frame ladder that did not extend 3 feet above the surface being accessed.
