29 CFR 1926.651(j)(2): The employer did not ensure protection was provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both. Worksite: During excavation and construction of a residential foundation, the employer did not keep excavated materials or other materials including loose bricks and rocks from spoil piles that were up to (10) feet in height and less than (2) feet from the edge of the work area exposing employees to struck-by hazards.
