29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury: a) New residential construction, Lot 41, left side: On or about 8/30/2021, the employer exposed employees to struck-by hazards, in that they were operating a Carpenter CCN65 coil siding nail gun at 135 PSI without eye protection. Safety glasses were not provided to employees while conducting siding installation activities prior to the beginning of the work day. b) New residential construction, Lot 41, left side: On or about 8/30/2021, the employer exposed employees to struck-by hazards , in that they were operating a Dewalt DWE575 7 1/4 circular saw without eye protection. Safety glasses were not provided to employees while they were cutting Hardie board siding prior to the beginning of the work day.

29 CFR 1926.302(b)(5):The manufacturer's safe operating pressure for hoses, pipes, valves, filters, and other fittings were exceeded. (a) New residential construction, Lot 41, ground: On or about 8/30/2021, and at times prior, the employer exposed employees who were installing siding to struck-by hazards, in that they were operating a pneumatic carpenter CCN65 coil nail gun at 135 PSI . The safe operating air pressure for this tool is between 70-115PSI.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section: (a) New residential construction; Lot 41, right side: On or about 08/30/2018, the employer exposed employees to falls of 14-feet 2 inches to the lower level, in that a fall protection system was not provided to employee working from a pump jack scaffold while installing Hardie board siding.
