29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use. On or about September 2, 2021, and at times prior thereto, the employer had not implemented elements of a written Respiratory Protection Program for employees required to wear half-face and full-face respirators, exposing the employees to the hazard of inhaling hazardous chemicals and the aggravation of a cardiac or pulmonary condition. Required program elements that were not implemented include, but were not limited to, the following: 1910.134(c)(1)(ii): Employees had not received medical evaluations before being required to utilize respirators. 1910.134(c)(1)(iii): Employees had not received fit-tests before being required to utilize respirators.
