29 CFR  1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equaled or exceeded an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  (a) In the shop, a pallet dismantler operator was exposed to noise levels at 218.0% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 218.0% is approximately 95.6 dBA.  Sampling was performed for 468 minutes during one shift.  Zero exposure was assumed for the unsampled period of 12 minutes.  (b) In the shop, a saw operator was exposed to noise levels at 548.5% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 548.5% is approximately 102.2 dBA.  Sampling was performed for 414 minutes during one shift.  Zero exposure was assumed for the unsampled period of 66 minutes.  (c) In the shop, a pallet repair operator was exposed to noise levels at 174.3% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 174.3% is approximately 94.0 dBA.  Sampling was performed for 352 minutes during one shift.  Zero exposure was assumed for the unsampled period of 128 minutes.  (d) In the shop, a pallet repair operator was exposed to noise levels at 132.4% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 132.4% is approximately 92.0 dBA.  Sampling was performed for 397 minutes during one shift.  Zero exposure was assumed for the unsampled period of 83 minutes.  (e) In the shop, a new pallet builder was exposed to noise levels at 251.7% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 251.7% is approximately 96.6 dBA.  Sampling was performed for 439 minutes during one shift.  Zero exposure was assumed for the unsampled period of 41 minutes.  Alvarez Pallet LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.95(c), which was contained in OSHA inspection number 1408890, citation number 1, item number 1 and was affirmed as a final order on September 24, 2019, with respect to a workplace located at 121 La Paz Street, Dallas, Texas 75217.
