29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  a) St. Ignatius Nursing & Rehabilitation Center located at 4401 Haverford Avenue, Philadelphia, PA 19104:  On or about September 9, 2021 the employer did not develop a written respiratory protection program with worksite-specific procedures. The employer required employees to wear N95 filtering facepiece respirators, including but not limited to 3M 8210 N95, to protect against SARS-CoV-2 while in areas designated yellow for unknown COVID-19 status.

29 CFR  1910.134(e)(3)(i):The employer did not provide a follow-up medical examination for employees who gave a positive response to any question among questions 1 through 8 in Section 2, Part A of Appendix C, or whose initial medical evaluation demonstrated a need for a follow-up medical examination:  a) St. Ignatius Nursing & Rehabilitation Center located at 4401 Haverford Avenue, Philadelphia, PA 19104:  On or about September 9, 2021, the employer did not provide a follow-up medical examination prior to fit testing and required use of N95 respirators when the employee's initial medical evaluation demonstrated the need for a follow-up medical examination. The employer required employees to wear N95 filtering facepiece respirators, including but not limited to 3M 8210 N95, to protect against SARS-CoV-2.

29 CFR 1910.134(k)(1): The employer did not provide effective training that covered the required elements in 1910.134(k)(1)(i) - (vii):  a) St. Ignatius Nursing & Rehabilitation Center located at 4401 Haverford Avenue, Philadelphia, PA 19104:  On or about September 9, 2021, and continuing thereafter, the employer did not provide employees with effective training related to respiratory protection, including the importance of seal check and effects of improper fit, limitations, maintenance and care, and medical signs and symptoms preventing effective use of filtering facepiece respirators. The employer required employees to wear N95 filtering facepiece respirators, including but not limited to 3M 8210 N95, to protect against SARS-CoV-2.
