29 CFR 1910.28(b)(12)(i): The employer did not ensure that each employee on a scaffold is protected from falling in accordance 29 CFR part 1926, subpart L. a) On or about September 10, 2021, The employees did not attach their personal fall protection arrest system while moving the swing scaffold system between the ground level and the secondary roof, exposing them to a 20-feet to level. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.28(b)(13)(i): The employer did not ensure that when work is performed less than 6 feet (1.6 m) from the roof edge, each employee is protected from falling by a guardrail system, safety net system, travel restraint system, or personal fall arrest system. a) On or about September 10, 2021, Secondary roof area; the employees did not attach their personal fall arrest systems while positioning the swing scaffold system from the roof edge, exposing them to a 20-foot fall. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.
