29 CFR  1926.501(b)(11):Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  (a)Wilder Lopez Villanueva at 7701 North Cliff Avenue, Sioux Falls, SD 57104:  On or about and at times prior to September 9, 2021, the exposing employer did not ensure employees were protected from fall hazards. Employees were engaged in re-roofing activities on a 6-in-12 pitched roof on a commercial building without the use of a fall protection system. This condition exposed employees to fall hazards greater than eight feet.

29 CFR  1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer:   (a)Wilder Lopez Villanueva at 7701 North Cliff Avenue, Sioux Falls, SD 57104:  On or about and at times prior to September 9, 2021, the exposing employer did not ensure a written fall protection training certification record was prepared which included the identifies of employees trained, dates of training, and the signatures of the trainer or employer. Employees were conducting re-roofing operations on a 6-in-12 roof of a commercial building without the use of a fall protection system. This condition exposed employees to fall hazards of approximately eight feet.  Abatement Note: The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.
