29 CFR 1910.134(c)(1): The employer did not establish and implement a written respiratory protection program with worksite-specific procedures in any workplace where respirators were necessary to protect the health of the employee or whenever respirators were required by the employer:  On or about August 25, 2021, the employer did not ensure that each of the following provisions were established and implemented in the respiratory protection program where employees are required to wear respirators during foam spraying operations:   1910.134(c)(1)(i)-Procedures for selecting respirators for use in the workplace;  1910.134(c)(1)(ii)-Medical evaluations of employees required to use respirators;  1910.134(c)(1)(iii)-Fit testing procedures for tight-fitting respirators;  1910.134(c)(1)(iv)-Procedures for proper use of respirators in routine and reasonably foreseeable emergency situations;  1910.134(c)(1)(v)-Procedures and schedules for cleaning, disinfecting, storing, inspecting, repairing, discarding and otherwise maintaining respirators;  1910.134(c)(1)(vi)-Procedures to ensure adequate air quality, quantity, and flow of breathing air for atmosphere-supplying respirators; 1910.134(c)(1)(vii)-Training of employees in the respiratory hazards to which they are potentially exposed during routine and emergency situations;  1910.134(c)(1)(viii)-Training of employees in the proper use of respirators, including putting on and removing the, any limitations on their use, and their maintenance; and 1910.134(c)(1)(xi)-Procedures for regularly evaluating the effectiveness of the program.

29 CFR 1926.150(c)(1)(vi): A fire extinguisher, rated not less than 10B, was not provided within 50 feet of wherever more than 5 gallons of flammable or combustible liquids or 5 pounds of flammable gas was being used on the jobsite.   On or about August 25, 2021, one employee was preparing to refuel a Ingersoll Rand air compressor with unleaded gasoline located inside of a 12 foot trailer without being provided a fire extinguisher, exposing the employee to fire and explosion hazards.

29 CFR  1904.39(a)(2):The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours.   On or about August 25, 2021, at approximately 2:18PM, an employee suffered an injury that resulted in a hospitalization. The hospitalization was not reported within 24 hours to the local Area Offices of the Occupational Safety and Health Administration.

On or about August 25, 2021, the employer did not develop and implement a written hazard communication program for employees working with and around hazardous chemicals, exposing employees to hazardous chemicals such as, but not limited to Benzene, Toluene, Acetaldehyde, Carbon Oxides, Nitrogen Oxides, Phosphorus Oxides and Halogenated compounds.  Required program elements that were not developed and implemented include the following:  1910.1200(f): Labels and other forms of warning. 1910.1200(g): Safety data sheets. 1910.1200(h): Employee information and training.
