29 CFR 1926.100(a):Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:(a)(LOCATION)(SPECIFIC OPERATION(S) AND/OR CONDITIONS) On or about September 16, 2021 and at times prior thereto, employees were engaged in frame work on a three story construction site, the employees were working below other construction workers that were using hand tools and other construction material with out the use of a hard hat, exposing them to a struck by hazards by tools or materials falling from a higher level.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about September 16, 2021, and times prior thereto, employees were doing framing work on on a 3 story commercial building without the use of fall protection on levels two and three, exposing the employees to the hazard of falling approximately 15-25 feet to a lower level.

29 CFR 1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed. On or about September 16, 2021, and times prior thereto, employees on the third floor of the commercial building under construction were using a ladder to access an upper level without the ladder extending at least 3 feet above the upper landing surface, exposing the employees to the hazard of falling approximately 10 feet to a lower level.
