29 CFR  1926.451(g)(1):Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.  (a) On or about September 23, 2021 at the construction site 1620 Stardust Dr. Waukesha, WI 53186, employees were conducting siding installation activities on a pump jack scaffolding with no fall protection systems in place and did not protect from falling to the lower level. This exposed employees to a fall hazard of approximately eleven feet.

29 CFR  1926.451(c)(2):Supported scaffold poles, legs, posts, frames, and uprights shall bear on base plates and mud sills or other adequate firm foundation.  (a) On or about September 23, 2021 at the construction site 1620 Stardust Dr. Waukesha, WI 53186 , the employer did not ensure pump jack scaffolding had adequate means of firm foundation to include a base plate or mud sills. This exposed employees to a scaffolding failure and fall of approximately eleven feet.

29 CFR  1926.454(a):The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:  (a) On or about September 23, 2021, the employer did not ensure employees exposed to potential fall hazards and hazards associated with the type of scaffolding being used, had been trained to recognize and minimize the fall hazards associated with their work. The CSHO observed no fall protection gear(anchor points, rope lines/life lines) or guard rail systems available for use by employees.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  (a) On or about September 23, 2021, at the construction site located at 1620 Stardust Ct Waukesha, WI 53186, an employee was performing siding installation activities from a rooftop on a single family residential home with no fall protection system in place and was not protected from falling to the lower level. This exposed an employee to a fall hazard of approximately eight feet.
