OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to tip-over hazards and structural failures (collapses) from the improper use of an aerial lift: a) Work Site - On or about October 2, 2021, a Genie Z-60/34 aerial lift was observed being utilized to lift insulated metal roof panels suspended from the work platform of an aerial lift not rated for lifting overhanging loads. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.453(b)(2)(v): A body belt or harness was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated. a) Work Site - On or about October 2, 2021, an employee was observed working from the basket of a Genie Z-60/34 aerial lift approximately 26 feet-8 inches above ground and was not wearing a body belt (or harness) with lanyard attached to the boom or basket and was exposed to a fall hazard. No abatement certification or documentation required.

29 CFR 1926.760(a)(1): Except as provided by paragraph (a)(3) of this section, each employee engaged in a steel erection activity who was on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems: a) Steel-framed Building - On or about October 2, 2021, an employee placed and secured metal roof panels onto the uppermost part of a steel framed structure and was not protected from an approximate 26 foot - 8 inch fall hazard at the exterior side of the building. No abatement certification or documentation required.
