29 CFR  1910.178(l)(1)(i):The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  On or about September 24, 2021, employees were exposed to a struck by hazard while performing  sawmill operations at Mast Sawing LLC.  Employees were operating a CAT Model 924K Fork Truck to move and stack lumber in the storage areas of the main yard and the employer did not ensure that the operators were trained to operate the fork lift safely.

29 CFR  1910.178(n)(6): Industrial truck drivers were not required to look in the direction of, and keep a clear view of the path of travel:   On or about September 24, 2021, employees were exposed to a struck by hazard while performing sawmill operations at Mast Sawing LLC.  Employees were operating a CST Model 924K Fork Truck to move and stack lumber to the storage areas in the main yard and the employer did not ensure that the operators were trained to operate the fork lift safely and look in the direction of travel.

29 CFR  1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been  taken out of service until restored to safe operating condition(s):   On or about September 24, 2021, employees were exposed to a struck by hazard while performing sawmill operations at Mast Sawing LLC.  Employees were operating a CAT Model 924K Fork Truck to move and stack lumber to the storage areas in the main yard and the employer did not ensure that the machine was taken out of service when the backup warning alarm was found to not operational.

29 CFR  1904.39(a)(1): The employer did not report within 8-hours the death of an employee resulting from a work-related incident    On or about September 24, 2021, the employer did not report within 8 hours the fatal accident of an employee  while performing saw mill activities at his workplace.  OSHA was not notified of the fatality until on or about September 27, 2021. The accident was not reported by the employer,  OSHA was notified of the accident by the local police department.
