29 CFR  1926.100(a): Workers working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets.  On or about October 7, 2021, and at times prior thereto, three workers were framing a home under new construction while working under each other in order to hand materials and tools upward, exposing workers to the hazard of being struck by a falling object.

29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee was using eye or face protection when exposed to eye or face hazards from flying particles.  On or about October 7, 2021 and at times prior thereto, three workers were using pneumatic nail guns to secure trusses to frame a new residential home under construction without using eye protection, exposing the workers to the hazard of being struck by flying objects.
