29 CFR 1926.451(c)(2)(i): Footings were not level, sound, rigid, and capable of supporting the loaded scaffold without settling or displacement. On or about 10/12/2021, Wilson Gunera was installing siding on a residence located on lot 95 on Myatt Drive in Wentzville, MO. The owner and an employee were working from pump jack scaffoldings on the side and rear of the residence. Two of the four poles for the scaffoldings were missing mud sills and or base plates, settling into the ground. The other two poles were not on footings that were level, sound, rigid and capable of preventing displacement.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level was not protected from falling to that lower level. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part. On or about 10/12/2021, Wilson Gunera was installing siding on a residence located on lot 95 on Myatt Drive in Wentzville, MO. The owner and an employee were working from pump jack scaffoldings on the side and rear of the residence, approximately eleven to sixteen feet above the ground, without utilizing fall protection.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access. On or about 10/12/2021, Wilson Gunera was installing siding on a residence located on lot 95 on Myatt Drive in Wentzville, MO. The owner and an employee were working from pump jack scaffoldings on the side and rear of the residence. The owner and employee were using portable ladders to access the pump jack scaffoldings. The top of ladders were nearly level with the walk boards and leaning against the residence. They were not extended three feet beyond the walk board to access the scaffolding safely.
