29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) New townhome construction located on Lot #21 Duval Drive, Alpharetta, GA 30009, Roof: On or about 10/15/2021, the employer exposed employees to fall hazards of over 20-feet, 4-inches to the lower ground level, in that a fall protection system was not provided to employees engaged in sheathing activities on a 6/12 pitched roof.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   a) New townhome construction located on Lot #21 Duval Drive, Alpharetta, GA 30009, Rear side second level window rough opening: On or about 10/15/2021, the employer exposed employees to fall hazards of 13-feet, 4-inches to the lower ground level, in that a ladder with side rails extending at least 3-feet past the second level landing/entrance was not provided to allow safe access to each level. The ladder provided was also not secured to the structure to prevent movement during use.

29 CFR  1926.403(b)(1): Employer did not ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees:   a) New townhome construction located on Lot #21 Duval Drive, Alpharetta, GA 30009, Front side of structure: On or about 10/15/2021, the employer failed to inspect all electrical cords used to power circular saws and reciprocating saws on site, in that ground pins on the energized cords used to provide power to this equipment were missing and not repaired or removed from service before the start of the shift.
