29 CFR  1926.451(g)(1):Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  (a)  DHK Construction LLC at 6147 - 6145 Alki Place, Sioux Falls, SD 57108:  On or about and at times prior to October 19, 2021 the exposing employer did not ensure that employees were protected from falls while conducting siding operations on a residential property and working on pumpjack scaffolding above 10 feet.  This condition exposed employees to fall hazards greater than 10 feet.

29 CFR  1926.454(a):The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  (a)  DHK Construction LLC at 6147 - 6145 Alki Place, Sioux Falls, SD 57108:  On or about and at times prior to October 19, 2021 the exposing employer did not ensure that employees were trained in the use of the Titan brand pump jack scaffolding being used on site for siding operations on a residential property.  This condition exposed employees to fall hazards greater than 10 feet.

29 CFR  1926.451(c)(2):Supported scaffold poles, legs, posts, frames, and uprights did not bear on base plates and mud sills or other adequate firm foundation:  (a)  DHK Construction LLC at 6147 - 6145 Alki Place, Sioux Falls, SD 57108:  On or about and at times prior to October 19, 2021, the exposing employer did not ensure that the Titan pump jack scaffolding on the north side of the residential property did not bear on base plates and mud sills or other adequate firm foundations in that the pump jack pole was bearing directly on the sand/dirt of the ground below.  This condition exposed employees to potential stability issues and falls while working from the scaffolding system in the event of a collapse of the structure.
