29 CFR  1910.134(c)(1):  A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:   On or about October 12, 2022, the employer did not have a written respiratory program with all of the elements required to protect the health of the employees who were provided and required to use half-face and N95 respirators for cleaning inside grain bins were exposed to inhalation of airborne grain dust.

The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator:  On or about October 12, 2021, employees who were provided and required to use half-face and N95 respirators while cleaning inside grain bins were not  provided a medical evaluation before the use of respirators.
