29 CFR 1926.453(b)(2)(iv): Employee(s) were not standing firmly on the floor of the basket, were sitting or climbing on the edge of the basket, or were using planks, ladders, or other devices for a work position. On or about October 22, 2021, one employee was performing framing activities on a residential building under construction using a Telescopic Boom Lift JLG Model 450AJ. While performing these framing activities the worker climbed the mid and top rail of the aerial boom lift, exposing the employee to the hazard of falling from height.

29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift. On or about October 22, 2021, an employee was operating a Telescopic Boom Lift JLG Model 450AJ to perform framing activities on an apartment complex under construction without the use of fall protection, exposing the employee to the hazard of falling approximately 43 feet from the aerial lift.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. On or about October 22, 2021, and at times prior thereto, one employee was performing framing activities on an apartment complex under construction using a Telescopic Boom Lift JLG Model 450AJ. The employee had not been trained on how to properly use the equipment by the Employer, exposing the employee to the hazard of falling from height.
