Located at 1170 E Powell Rd., Lewis Center, Ohio: On or about October 28, 2021, and at times prior, the employer did not initiate and maintain safety and health programs to ensure that hazards were identified and corrected onsite while employees performed commercial and residential painting activities. As a result, employees were exposed to hazards including, but not limited to, contact with chemicals and falls from height, associated with their job tasks.

Located at 1170 E Powell Rd., Lewis Center, Ohio: On or about October 28, 2021, and at times prior, employees were exposed to chemical hazards and fall hazards while performing commercial and residential painting activities. The employer did not provide safety and health training to employees on the avoidance of unsafe conditions or elimination of hazards while performing commercial and residential painting work including, but not limited to, fall prevention and protection, hazard communication, ladder safety, and personal-protective equipment.

Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a. Located at 1170 E Powell Rd., Lewis Center, Ohio: On or about October 28, 2021, employees were performing staining on the exterior of the existing building while standing on the slanted portion of the roof without any fall protection measures in place. As a result, the employees were exposed to a fall hazard of approximately 11 feet. b. Located at 1170 E Powell Rd., Lewis Center, Ohio: On or about October 28, 2021, employees were performing staining on the exterior of the existing building while standing on the flat roof without any fall protection measures in place. As a result, the employees were exposed to a fall hazard of approximately 18 feet.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. a. Located at 1170 E Powell Rd., Lewis Center, Ohio: On or about October 28, 2021, employees were utilizing an aluminum extension ladder to access the roof to perform staining activities. The ladder was not extended at least 3 feet above the upper landing surface nor did it have other acceptable measures in place. As a result, employees were exposed to falls of approximately 18 feet.
