OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. Location: Jobsite The employer was exposed to falls while using a Nifty, model #SP64 aerial lift as a crane to move logs when the basket failed sending the employer to the ground below.

29 CFR 1910.30(a)(1): The employer did not provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart before any employee is exposed to a fall hazard. And/or the employer did not ensure employees are trained in the requirements of this paragraph on or before May 17, 2017. Location: Jobsite The employer was not adequately trained in fall protection where the employer was injured from falling from an aerial lift and striking the ground.

29 CFR 1910.140(d)(2)(ii): The employer did not ensure that personal fall arrest systems are rigged in such a manner that the employee cannot free fall more than 6 feet (1.8 m) or contact a lower level. A free fall may be more than 6 feet (1.8 m) provided the employer can demonstrate the manufacturer designed the system to allow a free fall of more than 6 feet and tested the system to ensure a maximum arresting force of 1,800 pounds (8 kN) is not exceeded. Location: Jobsite The employer failed to connect the lanyard to the personal fall arrest system being worn, while working from an aerial lift of heights in excess of 6-feet to perform tree removal. The employer fell out of the bucket, struck the ground below, and was hospitalized from the injuries.
