29 CFR  1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes:  a) On or about 11/16/2021 at a commercial flat roof project located at 555 Pearl St. Buffalo, New York.  Employees, working on the roof to repair damaged skylights, lacked fall protections. Employees were exposed to fall of 20 feet.  NO ABATEMENT CERTIFICATION REQUIRED

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) On or about 11/16/2021, at the roof area of the site, Buffalo, NY. Employees, who used extension ladders to access the roof, did not extend ladder side rails at least 3 feet (.9 m) above the upper landing surface being accessed.  NO ABATEMENT CERTIFICATION REQUIRED
