29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) On or about 10/27/2021 at a residential roofing project located at 3328 Zoeller Road, Alden, New York; employees were installing metal roofing on a 2 story house with an eave height of approximately 20 feet. An employee lost his footing and fell to the ground suffering fatal injuries from the fall. The were no fall protection measures in place.  NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1904.39(a)(1): The employer did not report within 8-hours the death of an employee resulting from a work-related incident:  a) On or about 10/27/2021; where an employee died after falling from a 2 story house while roofing. The employer did not notify OSHA of the death. OSHA became aware of this fatality through an anonymous source on 11/16/2021.  NO ABATEMENT CERTIFICATION REQUIRED
