(a) Back Yard, Trench - On or about November 17, 2021, workers were exposed to a struck by hazard from a spoils pile, rocks, lumber and materials located that were unrestrained and not located at least 2 feet back from the edge of a 52 foot long trench where they were installing PVC sewer pipes. 29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: (a) Back Yard, Trench - On or about November 17, 2021, workers were exposed to a struck by hazard from spoils piles located at the open edge of a 52 foot long trench, over 5.5 feet deep, was not provided with protective systems to prevent cave-ins and no proper ladder access for the trench was not inspected by a competent person and the hazards removed before workers were allowed to enter the trench. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
