29 CFR  1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  (a) On or about November 30, 2021, employees installed a gas insert to a chimney of a residential building without implementing the use of fall protection. This exposed employees to a fall hazard of approximately 11 feet from the eve to the lower level.

29 CFR  1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii).  (a) On or about November 30, 2021, employees conducting chimney work on the roof of a residential building were not provided with training on how to minimize or eliminate fall hazards by a competent person. This exposed employees to a fall hazard of approximately 11 feet.

29 CFR  1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  (a) On or about November 30, 2021, the extension ladder being used to access the roof to install a gas insert to a chimney, did not extend at least three feet above the upper landing area. This exposed employees accessing and egressing the roof to a fall hazard of approximately 11 feet.
