On or about November 30, 2021, the employer failed to initiate and maintain a safety and health program to ensure hazard detection and correction while employees conducted siding work to a new build residential home. The employees were exposed to a fall hazard of 12 feet 3 inches from the top of the pump jack scaffold and garage roof top eave to the gravel ground level as a result.

On or about November 30, 2021, the employer did not instruct employees on the avoidance of unsafe conditions while an employee installed while employees conducted siding work to a new build residential home. The employees were exposed to a fall hazard of 12 feet 3 inches from the top of the pump jack scaffold and garage roof top eave to the gravel ground level as a result.

29 CFR 1926.451(b)(5)(ii): Each platform greater than 10 feet in length shall not extend over its support more than 18 inches (46 cm), unless it is designed and installed so that the cantilevered portion of the platform is able to support employees without tipping, or has guardrails which block employee access to the cantilevered end. a. On or about November 30, 2021, the employer did not ensure the working surface of the pump jack scaffold platform did not extend over its support more than 18 inches. The platform extended approximately 6 feet past the support. The scaffold system had the potential to tip as a result when the employee worked at the unprotected and unguarded end of the scaffold system.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part. a. On or about November 30, 2021, the employer failed to ensure that an employee who worked on top of the pump jack scaffold was protected from falling. 29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems. a. On or about November 30, 2021, the employer failed to ensure that an employee was protected from falling when siding work was done on top of the garage roof of a new build residential home. An a employee was exposed to a fall hazard of 12 feet 3 inches to the gravel ground level as a result.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. a. On or about November 30, 2021, the employer failed to ensure that the ladder side rails extended at least three feet above the upper landing surface used to gain access to the working level at the front side garage roof top of the new build residential home. b. On or about November 30, 2021, the employer failed to ensure that the ladder side rails extended at least three feet above the upper landing surface used to gain access to the working level at the garage side roof top of the new build residential home.
