29 CFR  1926.453(b)(2)(v):A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).  (a) On or about November 30, 2021, at the construction site located at 10448 N. Port Washington Rd Mequon, WI 53092, an employee was performing siding activities on a commercial building while in an aerial lift with a fall protection system in place but not connected to appropriate anchor points and was not protected from falling to the lower level. This exposed an employee to a fall hazard of approximately nine feet.

29 CFR  1926.1053(b)(13):The top or top step of a stepladder shall not be used as a step.  (a) On or about November 30, 2021, at the construction site located at 10448 N. Port Washington Rd. Mequon, WI 53092, an employee was performing siding activities on a commercial building while standing on the top step of portable stepladder. This exposed an employee to a fall hazard of approximately 6 feet.  (b) On or about November 30, 2021, at the construction site located at 10448 N. Port Washington Rd. Mequon, WI 53092, an employee was performing siding activities on a commercial building while standing on the top cap of portable stepladder. This exposed an employee to a fall hazard of approximately 6 feet.
