29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames, or uprights did not bear on base plates and mud sills or other adequate firm foundation: a) BYRON LEONEL ARANA VARELA located at 3955 Ebrington Road, New Albany, OH 43054: On and preceding December 1, 2021, a supported scaffold that was in use did not bear an adequate firm foundation. A two tier supported scaffold positioned at the back of a home was being utilized by masonry workers which was not resting on a stable foundation. The following condition exposed employees to falls in excess of 16 feet and struck-by hazards should the scaffolding collapse.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used. a) BYRON LEONEL ARANA VARELA located at 3955 Ebrington Road, New Albany, OH 43054: On and preceding December 1, 2021, a supported scaffold that was in use did not have an adequate means for access in place which led to masons using the scaffolding structure to climb the side of the scaffold to access the upper level. The following condition exposed employees to falls in excess of 16 feet while transitioning from the side structure to the platform.

29 CFR 1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity: a) BYRON LEONEL ARANA VARELA located at 3955 Ebrington Road, New Albany, OH 43054: On and preceding December 1, 2021, the employer did not ensure that scaffolds and scaffold components were inspected for correct installation by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity. A two tier supported scaffold positioned at the back of a home was being utilized by masonry workers which had visible deflects including but not limited to missing guardrails, missing planking and missing crossbracing which was not identified and corrected before the scaffold was utilized. The following condition exposed employees to falls in excess of 16 feet and struck-by hazards should the scaffolding collapse.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level. a) BYRON LEONEL ARANA VARELA located at 3955 Ebrington Road, New Albany, OH 43054: On and preceding December 1, 2021, the employer did not ensure that employees on scaffolds more than 10 feet above a lower level were protected from falls. Masonry workers were positioned on the second level of a two tier scaffold, approximately 16 feet high installing brick and other masonry pieces. The second tier and other sections of the scaffolding did not have guardrails or other means of fall protection installed which exposed employees to falls in excess of 16 feet.
