29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) AND AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d):  29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):  Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.   On or about December 1, 2021, and at times prior thereto, employees were operating an XTREME XR842 Telehandler to lift paint containers without training on its safe operation.

29 CFR 1926.503(c): The employer did not retrain affected employees  who already had been trained but demonstrated inadequate  understanding and skill required by paragraph (a) of this section:  Rooftop:  On or about December 1, 2021, employees were exposed to a fall hazard greater than 6 ft to the ground below while using a warning line system without another form of fall protection.
