29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  (a) On or about December 1 , 2021, Dirt Cheap Excavating, as the controlling employer, did not ensure that employees working in areas where there was possible danger of head injury from impact, or falling objects, were protected by protective helmets.   Employees of New Gold of Globe Hill, a subcontractor, were exposed to struck-by hazards while working at the bottom of an excavation 11 feet deep with loose rocks, larger than 12" in diameter, located at the edge of the excavation.  Employees were not wearing protective helmets.     Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR  1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations, or by a combination of both if necessary.:  (a)or about December 1, 2021, Dirt Cheap Excavating, as the controlling employer, did not ensure that each employee was protected from excavated materials that could pose a hazard by falling or rolling into the excavation. Employees of New Gold of Globe Hill, a subcontractor,  were exposed to struck-by hazards while installing sewer piping in an excavation 11 feet deep and 3.5 feet wide. The excavation spoils, including loose rocks larger than 12" in diameter, were not kept at least 2 feet away from the edge of the excavation. Employees of New Gold of Globe Hill, a subcontractor, were exposed to cave-in hazards while installing sewer piping in an excavation 11 feet deep and 3.5 feet wide, without the benefit of a cave-in protection system. 29 CFR  1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  (a) On or about December 1, 2021, Dirt Cheap Excavating, as the controlling employer, did not ensure that portable ladders used to access an upper landing extended at least 3 feet past the landing surface. Employees of New Gold of Globe Hill, a subcontractor, were exposed to fall hazards of up to 9 feet while using a ladder to access and egress an excavation 9 feet deep.
