29 CFR  1910.1026(d)(1): The employer with a workplace or work operation covered by this standard did not determine the 8-hour time-weighted average exposure for each employee exposed to chromium (VI).  On or about December 2, 2021, and at times prior thereto, three employees were performing welding activities on stainless steel materials without the employer performing personal monitoring to determine the 8-hour TWA exposure to Chromium (VI) for each employee, exposing the employees to the hazard of Chromium (VI).

29 CFR  1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible.  On or about December 2, 2021, and at times prior thereto, employees in the Welding Department were permitted to voluntarily use N95 filtering facepiece respirators without being provided with the information contained in Appendix D, exposing the employees to respiratory hazards.
