29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) and referenced by the note contained in 1926.602(d):  a)Howey Construction LLC, at 308 North Wildcat Drive, Sioux Falls, SD 57110:  On or about and at times prior to December 3, 2021, the employer failed to ensure employees were trained or certified to operate a Genie rough terrain telehandler on the residential jobsite with uneven driving surfaces and obstacles, in that two of three employees were found to be regularly operating the telehandler without any formal training or certification provided by their employer or other source.  This condition exposed employees to crushed-by hazards associated with improper operation of a complex piece of construction equipment.    Abatement Note: Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance.

29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):   (a) Howey Construction LLC, at 308 North Wildcat Drive, Sioux Falls, SD 57110: On or about and at times prior to December 3, 2021 the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. This condition exposed employees to a variety of hazards identified on site.   Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR  1926.100(a):Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  (a)Howey Construction LLC at 308 North Wildcat Drive, Sioux Falls, SD 57110:  On or about and at times prior to December 3, 2021, the exposing employer did not ensure that employees were protected from overhead hazards such as tools and materials falling while conducting framing operations on a residential property.   This condition exposed employees to overhead struck-by hazards while working underneath ongoing roofing operations including blocking and sheathing operations.

29 CFR  1926.102(a)(1):Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical agents:  a)  Howey Construction LLC, at 308 North Wildcat Drive, Sioux Falls, SD 57110:  On or about and at times prior to December 3, 2021, the employer did not ensure employees were protected from flying particles from pneumatic and electrical hand tools in that employees were operating pneumatic nail guns as well as operating circular hand saws without eye protection.  This condition exposed three employees to struck-by hazards that could lead to serious eye injury.
