OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards:  a) Storage Area: On December 1, 2021 and at times prior, employees were exposed to struck-by hazards while loading and unloading an unknown weight of materials on storage racks that were green and orange in color.  b) Storage Area: On December 1, 2021 and at times prior, employees were exposed to struck-by hazards in the event of a storage rack collapse while working in and around damaged storage racks that were green and orange in color.  c) Storage Area: On December 1, 2021 and at times prior, employees were exposed to struck-by hazards in the event of a storage rack collapse while working in and around storage racks that were not securely anchored to the floor that were green and orange in color.

29 CFR  1910.178(a)(4):Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:  a) Outside Pad: On December 1, 2021 and at times prior, employees were exposed to struck by hazards while utilizing the shop made hole in the forklift to attach a ball hitch for moving trailers throughout the facility. The employer failed to obtain manufacturers prior written approval prior to modifying the forks on the Toyota Forklift Truck Serial#34462.
