29 CFR 1910.1200(e)(1):The employer did not develop, implement and maintain at the workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g) and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met:  a) On or about December 1, 2021, At the Refresco facility, the employer did not develop and implement a written hazard communication program for employees who are exposed to hazardous chemicals such as but not limited to Hydrogen Peroxide, ENFORCE LP (which contains sodium hydroxide and sodium hypochlorite), and FOAM-SHINE (which contains phosphoric acid and methanesulphonic acid). The chemicals are used to sterilize and clean machines.

29 CFR  1904.40(a):The employer did not provide copies of the records kept under part 1904-Recording and Reporting Occupational Injuries and Illnesses- within four (4) hours when an authorized representative of the Commissioner asked for the records:  On December 8, 2021, the Compliance Officer requested the OSHA log 300, 300A, and 301 for the years 2015 to 2021. Only the  OSHA logs for the year 2021 were provided on January 11, 2022.
