29 CFR 1910.29(b)(1):  The employer did not ensure that  guardrail systems met the requirement that the top edge height of top rails, or equivalent guardrail system members, were 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface. The top edge height may exceed 45 inches (114 cm), provided the guardrail system meets all other criteria of paragraph (b) of this section (see Figure D-11 of this section):  a) Jobsite, 703 Stevenson Boulevard, New Kensington, PA 15068:  On or about December 14, 2021, a guardrail on a catwalk located above the auditorium was installed such that the top edge height of the top rail was not 42 inches plus or minus 3 inches.  The top height of the guardrail was measured at two locations along the catwalk.  The top height was found to be 36 inches at one location and 34.5 inches at another location near where an employee fell through a drop ceiling.  Employees using the catwalk while engaged in HVAC maintenance and repair activities were exposed to a fall hazard of approximately 30 to 40 feet to the auditorium floor and seats below.
