1926.502(d)(15)(ii)  29 CFR 1926.502(d)(15)(ii): Anchorages used for attachment of personal fall arrest systems were not designed, installed and used under the supervision of a qualified person: 29 CFR  1926.502(d)(16)(iii):Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level:  On or about December 1, 2021: Employees engaged in framing activities at the Runza construction site located at 8910 Fort St. Omaha, Nebraska, were exposed to fall hazards in that the employees were not using a fall protection system that do not allow the wearer to contact the next lower surface (ground) based upon the configuration of the system.  The fall protection system was used in such a way that the anchorage point (unsecured wooden truss) moved allowing the employee to contact the ground and sustain fatal injuries.

29 CFR  1926.502(d)(15):Anchorages used for attachment of personal fall arrest equipment were not independent of any anchorage being used to support or suspend platforms and/or were not capable of supporting at least 5,000 pounds (22.2 kN) per employee.  On or about December 1, 2021: Employees engaged in framing activities at the Runza construction site located at 8910 Fort St. Omaha, Nebraska, were exposed to fall hazards in that an employee was using a fall protection system that was used in such a way that the anchorage point being used by the employee could not support 5,000 pounds per employee.  The fall protection system was used in such a way that the anchorage point (used wooden truss) moved allowing the employee to contact the ground resulting in injury.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  On or about December 1, 2021: Employees engaged in framing activities at the Runza construction site located at 8910 Fort St. Omaha, Nebraska, were exposed to fall hazards in that the employees were not instructed in the recognition of the hazards associated with working at levels at and above 6 feet and the methods to mitigate those hazards with the safe use of a fall protection system.
